A penthouse is the top-floor unit of an apartment block, distinguished from an ordinary apartment by its position, a private terrace (often wraparound), and sometimes a private roof area or pool. Estate agents list penthouses as a distinct sub-category, though NSO’s own price statistics group them together with apartments rather than tracking them separately. Many penthouses, particularly in newer developments, are sold in shell form - a bare structural shell for the buyer to design and fit out - rather than fully finished.
Airspace and roof rights need checking before you buy
Airspace - the right to build additional floors above an existing building - can be owned and sold entirely separately from the penthouse unit itself. A buyer should have the contract of sale state explicitly whether airspace above the unit is included, excluded, or already sold to someone else, since a third party retaining that right could later build directly above. Even where the Planning Authority has approved an airspace development permit, it doesn’t override existing third-party rights: Maltese case law has held that a resident’s recorded right of use over the roof - for a water tank, aerial, or general access - can prevail over a developer’s approved airspace permit where building would materially impair that use. This makes title research on roof and airspace rights a genuine transactional risk specific to penthouses, distinct from a standard structural survey.
A roof pool needs more than one permit
Adding a pool on a penthouse roof needs standard Planning Authority development permission, plus a perit-certified structural assessment of the roof’s load-bearing capacity - Malta’s active seismic classification makes this a real engineering question, not a formality. Once built, the pool separately needs a construction permit and operating licence from the Regulator for Energy and Water Services (REWS) before it can be used.
Where penthouses concentrate
Penthouse stock is concentrated in Malta’s high-rise and high-density planning zones - Sliema, St Julian’s, Gżira, Tigné Point and Portomaso - alongside newer development hotspots island-wide, but the strongest concentration of sea-view, luxury-finish stock sits in the Sliema-St Julian’s-Gżira belt.
Buying and renting
Penthouses command premium rents and strong demand from corporate and expat tenants who value terraces, privacy and views, but roof and terrace waterproofing and structural maintenance falls on the top-floor owner, and disputes over lift or roof access with other owners in the block are more common than in a mid-floor apartment. A shell-form purchase also requires budgeting a full separate fit-out on top of the purchase price.
